Orders, Shipments and Returns
Order and conclusion of the purchase contract:
By placing an order, the buyer confirms that he has read the complaint procedure and these terms and conditions and that he agrees with them.
The order is a draft purchase agreement. The purchase contract actually arises at the moment of taking over the ordered goods by the buyer.
The condition for the validity of the electronic order is the proper completion of all data and requisites prescribed by the form, especially the correct delivery address and contact telephone number.
The place of delivery of goods is the delivery address specified by the buyer in the order form.
Ownership of the goods passes to the buyer after its receipt and payment.
By filling out the registration form or ordering within the online store www.tombalinawines.cz, the buyer gives the seller consent to the collection and archiving of personal data about the buyer and his purchases.
Through delivery companies (within the Czech Republic outside Prague). The usual delivery is within 48 - 72 hours from receipt of the goods at our company. Weekdays are counted, not weekends and holidays.
When ordering more than CZK 2,000 incl. VAT is free shipping throughout the Czech Republic. When ordering up to 2,000 CZK incl. VAT is transport throughout the Czech Republic for 150 CZK incl. VAT.
Delivery time, time and place of delivery:
The usual delivery time is 3 days through the shipping company. The usual delivery times of delivery companies (delivery outside Prague) are 9.00 - 18.00 every working day. The seller cannot influence the delivery times of delivery companies. Delivery in Prague by courier service is also possible outside these hours. Before the delivery of the goods, Tombalina Wines will contact the customer and the delivery date will be agreed by both parties.
In the event that the seller is unable to ensure dispatch of the goods within 3 days, contact the buyer, inform him of the extended delivery time and agree with the buyer how to implement this order, or replace the goods with similar goods that are currently available. The shipment can be sent to any address throughout the Czech Republic. In case of delivery to work, it is necessary to state the name of the company.
In order to ensure distribution through courier services, Tombalina Wines distances itself from the behaviour and attitude of courier employees, which cannot always be guaranteed.
Possibility of withdrawal from the contract by the buyer:
It is possible to cancel the order before dispatch at any time by phone at 774 669 173 or on the basis of an e-mail sent by the buyer to the e-mail address of the seller, ie email@example.com.
In accordance with Act No. 367/2000, the buyer, as a private person (not at the ID number) has the right to withdraw from the contract within 14 days of receiving the goods. If the buyer decides to withdraw within this period, the following procedure and conditions must be followed:
Contact the seller and submit a written request for withdrawal from the contract. The request must include the order number, date of purchase and account number or refund address.
Returned goods must be in the original undamaged packaging, unused, undamaged and with the original proof of purchase attached. It is always necessary to secure the returned goods so that the original packaging cannot be glued, described or otherwise degraded during transport (eg using wrapping paper or cardboard).
The goods cannot be sent cash on delivery, such a shipment will not be accepted. It is recommended to insure the goods.
If the above procedure and conditions for returning the goods are met, the money will be sent by invoice or transfer to the customer's account no later than 5 working days after the physical receipt of the goods.
Withdrawal from the purchase contract by the buyer due to a wrong description of the goods or a bad picture is not possible. The name of the goods that the customer has ordered and confirmed is always binding. We reserve the right to make typographical errors on our website.
Withdrawal from the contract by the seller:
The seller is entitled to cancel the order (upon prior agreement with the buyer), especially in cases when he has a reasonable doubt as to the true identity of the buyer,
if he is unable to deliver the goods on time,
in cases where the goods are no longer manufactured or delivered,
when the price of the supplier of the goods has changed significantly.
If the buyer has already paid part or all of the purchase price, this amount will be transferred back to his account or address as soon as possible.
